Processing Personal Data

1. Informational Visits to Our Website

Every time our website is accessed, our system automatically collects data (so-called server log files) and information from the computer system of the accessing computer. When doing so, it collects the following data:

  • the visited website
  • the date and time of accessing the website
  • the quantity of data sent, in bytes
  • the source/referrer that brought you to the website (referrer URL)
  • the browser used
  • the operating system used
  • the IP address used
  • query details and target address

These data will not be merged with other data sources.

The purpose of storing them in log files is to ensure the functionality of the website. On top of that, the data help us optimise the website and ensure the security of our information technology systems. The data are not evaluated for marketing purposes in this context. Temporary storage of the IP address by the system is necessary to make the website available to the user’s computer. This necessitates storage of the user’s IP address for the duration of the session.

The lawful basis for temporarily storing the data and the log files is Art. 6, Sec. 1, Lit. f, GDPR. We have a legitimate interest in accordance with Art. 6, Sec. 1, Sent. 1, Lit. f, GDPR, to keep optimising our website.

 

2. Use of Cookies

3. Data Processing when Contacting Us via Our Homepage

If you contact us by e-mail, e.g. via the e-mail address quoted on our website, phone or postal letter, the personal data transmitted to us (e.g. your name, e-mail address, postal address, etc.) will be processed so as to enable us to respond to your inquiry. If you use the contact form on our website that is intended for this purpose to get in touch with us, you thereby consent to the processing of your personal data. The processing of personal data (title, first name, last name, company, phone, e-mail, type of query, your message) from the input mask serves the exclusive purpose of processing your query. Processing will be done in accordance with Art. 6, Sec. 1, Sent. 1, Lit. a and f, GDPR. If your registration concerns the fulfilment of a contract or pre-contractual measures, the lawful basis for data processing is Art. 6, Sec. 1, Sent. 1, Lit. b, GDPR.

 

4. Application Process

If you submit a job application via our website, we will process your personal data for the purpose of your application to the extent necessary in order to reach a qualified decision whether or not to enter into an employment relationship with you. Such personal data could be details about your person (e.g. name, address, contact details), information about your professional qualification and school education, continued vocational training or any other details that you communicate to us in the context of your application. Furthermore, we may process your personal data if doing so is necessary to deflect legal claims asserted against us in conjunction with the application process.

In case an employment relationship is established between you and us, we will continue to process the personal data already disclosed by you for the purposes of the employment relationship if doing so is necessary for the performance or termination of the employment relationship or for the exercise or fulfilment of statutory rights and obligations.

We do not use automated decision-making in individual cases pursuant to Art. 22, GDPR. This means that the decision regarding your application will not be based exclusively on automated processing.

The lawful basis for processing your personal data within the framework of the application process and, where relevant, for the performance or termination of the employment relationship is Art. 26, Sec. 1, German Data Protection Act (“BDSG”), i. c. w. Art. 6, Sec. 1, Sent. 1, Lit. b, GDPR. If legal claims are asserted against us, the processing of your personal data is done pursuant to Art. 6, Sec. 1, Sent. 1, Lit. f, GDPR. The legitimate interest to process your data in accordance with Art. 6, Sec. 1, Sent. 1, Lit. f, GDPR, derives from the processing purpose.

 

5. Newsletter

Our newsletters are intended for various target groups, including sales partners, business partners and press partners, for instance, as well as any interested party. We use them to update you on the latest news regarding our company, events and new projects.

Submitting your e-mail address gives you the chance to get regular e-mail updates on GARBE Industrial GmbH & Co. KG in the form of a newsletter.

The registration for our newsletter uses the so-called double-opt procedure. This means that, in response to your registration, we will send you a note to the e-mail address you submitted, asking you to confirm that you wish to receive the newsletter. Unless you confirm your registration, your disclosures will be blocked and deleted within a month’s time. In addition, we will store the IP address you used each time along with the time of your registration and confirmation. The purpose of doing so is to verify your registration and to clarify any misuse of your data, if any.

The disclosure required for the newsletter subscription is solely your e-mail address, which is needed for sending the newsletter. In addition, you may volunteer your salutation, first and last name, and the name of your company. Lawful basis for the data processing is Art. 6, Sec. 1, Sent. 1, Lit. a, GDPR.

We measure the performance of our newsletters on the user side. For newsletters dispatched, for instance, we determine the number of recipients who received the newsletter, the opening and click rate, the types of endpoint used to upload the newsletter, and the user engagement. Processing within the scope of the performance measurement is done using anonymous data. The purpose of the data processing is to provide a user-friendly and secure system to you, but also to review and optimise the processes used for demand analysis and customer acquisition. Lawful basis for the data processing is your consent pursuant to Art. 6, Sec. 1, Sent. 1, Lit. a, GDPR. By unsubscribing from the newsletter, you object to this evaluation process. After you unsubscribed, we will keep storing your data in anonymous form for statistical purposes. Your data will be deleted after 90 days.

You may revoke your consent to the sending and receiving of our newsletter at any time. Use the unsubscribe option included in every newsletter to do so. Your data collected within the context of our newsletter dispatch will then be deleted.

 

Sources

We receive personal data from contractual partners within the framework of our business relations. We also process personal data that we receive directly from our clients, agents, service providers, employees and job applicants. Furthermore, we process—to the extent necessary for the provision of a service—personal data that we receive from other group member companies or from other third parties (e.g. the SCHUFA and Creditreform credit protection agencies) in a lawful manner (e.g. for the performance of services, for the fulfilment of contracts or on the basis of your consent). Moreover, we process personal data that we lawfully obtained from publicly accessible sources (e.g. debtor directories, land registers, commercial registers and registers of societies, press, media, Internet) and that we may legitimately process.

 

Processing Purposes and Lawful Bases

We process personal data as stipulated by Art. 6, EU-GDPR, specifically pursuant to Art. 6, Sec. 1, Sent. 1, Lit. a, GDPR, on the basis of consent, Art. 6, Sec. 1, Lit. b, GDPR, to fulfil a contract, Art. 6, Sec. 1, Sent. 1, Lit. c, GDPR, to meet a legal obligation, Art. 6, Sec. 1, Sent. 1, Lit. d, GDPR, to uphold vital interests of the data subjects, Art. 6, Sec. 1, Sent. 1, Lit. f, GDPR, to uphold legitimate interests of our company or of a third party. On top of that, we process your personal data as stipulated by the Federal Data Protection Act (BDSG).

 

Disclosure of Personal Data

We will not disclose your personal data to any third party unless you consent to the disclosure, there is a legal obligation to disclose the data, the disclosure is part of fulfilling a contract or unless we can invoke legitimate interests in the economic and effective operation of our business operations to justify the disclosure.

Within the GARBE Group, we exchange data if and to the extent that a legitimate interest pursuant to Art. 6, Sec. 1, Lit. f, GDPR, justifies such intra-group disclosure.

Our third-party service providers were carefully selected and commissioned by us, are bound by our instructions, and are periodically monitored by us. Recipients of personal data include in particular: banks, advertising agencies, PR agencies, credit agencies, payroll offices, lawyers, IT service providers, employers’ liability insurance associations and government agencies (e.g. tax authorities, courts, public prosecutors’ offices and the police).

 

Transfer of Personal Data

Personal data will not be transferred to countries outside the EU or the EEA (so-called third countries) unless doing so is necessary to fulfil your orders, required by law (e.g. tax reporting requirements), unless you have granted your consent or unless it is done within the scope of contract data processing.

The service enables us to include map material on our website. Using the features of Mapbox necessitates the storage of your IP address, of your user agent and of other data. (a) Google Analytics

We use Google Analytics, a web analysis service provided by Google Ireland Ltd., Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”). Google Analytics uses cookies to identify the frequency with which certain sections of our website are used, and to identify preferences. The information generated by the cookies about your use of the website (including your truncated IP address) will generally be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of our website, to compile reports on website activity for us and to provide other services relating to the uses of the service and to Internet usage.

We use Google Analytics exclusively with the IP anonymisation enabled. (aa). We use the “Google Ads” online advertising programme on our website and, in this context, conversion tracking (visit action evaluation). Google Conversion Tracking is a web analysis service provided by Google Ireland Ltd., Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”).

If you consent to the use of this service, a cookie for conversion tracking will be stored on your computer when you click on an advert placed by Google. These cookies have a limited lifetime, contain no personal data and are therefore not used for personal identification. If you visit certain pages of our website and the cookie stored on your computer has not yet expired, Google and us, too, will recognise that you clicked on the ad and were redirected to our website. Each Google Ads client gets a distinct cookie. Accordingly, there is no way to track cookies via the websites of ads customers. (bb). Our website uses the remarketing function within the Google Ads service (see paragraph (a), above).

To this end, the interaction of users on our website is analysed, e.g. which offers a given user was interested in, in order to be able to display targeted advertising to users on other sites even after they completed their visit to our website. This is made possible by the fact that Google stores a number in the browsers of users who visit certain Google services or websites within the Google Display Network. Our website uses the so-called “Facebook pixel” of the Facebook social networking website, which is operated by Meta Platforms Inc, 1 Hacker Way, Menlo Park, CA 94025, USA, or Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”).

Facebook Pixel enables Facebook to define you and other visitors to our website as a target group for adverts (so-called “Facebook Ads”). In other words, we use the Facebook pixel to improve customer engagement on Facebook.
